If you read the training at https://MortgageFieldServices.com you already know that you not only have the authority to complete your inspection, but it’s now a law based on the passing of the Dodd/Frank Bill in 2010.
But just because we are authorized to be there, we do not have the right to display our authority by being belligerent and rude to the homeowners. We are not law enforcement, judges, gods or even employees of the bank or mortgage companies. We’re nobody. We just do the inspections. We have no authority to advise the homeowners to make their payments, tell them to get out of the way so we can take our photos, and we don’t have the right to park in their driveway. We have no rights. We do not assert any assumed rights.
If you are on a No Contact inspection and the people are out in their front yard, then drive to the next house. Don’t be stupid. “Whoever talks first loses” is in extreme circumstances where contact was unavoidable. Do not “stand your ground.” Be humble. Be respectful. Do not get into heated arguments with the homeowner. We will NOT back you up! Be nice and honorable, but don’t pretend that you are anything more than just a person hired to determine occupancy and condition. Our job is not to get into fights with the homeowners.
You probably guessed it, and you would be correct. We’ve had this situation recently and then we had no choice but to terminate the contract with the vendor or our client was going to terminate ours. Be nice.
